{"id":5316,"date":"2025-09-11T13:58:49","date_gmt":"2025-09-11T11:58:49","guid":{"rendered":"http:\/\/www.cechova.sk\/?p=5316"},"modified":"2025-09-11T13:59:56","modified_gmt":"2025-09-11T11:59:56","slug":"vybrane-zmeny-v-zakone-o-sluzbach-zamestnanosti","status":"publish","type":"post","link":"https:\/\/www.cechova.sk\/sk\/vybrane-zmeny-v-zakone-o-sluzbach-zamestnanosti\/","title":{"rendered":"Vybran\u00e9 zmeny v z\u00e1kone o slu\u017eb\u00e1ch zamestnanosti"},"content":{"rendered":"<p>1. septembra 2025 nadobudla \u00fa\u010dinnos\u0165 novela z\u00e1kona \u010d. 5\/2004 Z. z. o slu\u017eb\u00e1ch zamestnanosti a o zmene a doplnen\u00ed niektor\u00fdch z\u00e1konov (\u201e<strong>Novela<\/strong>\u201c).<\/p>\n<p>Novela priniesla zmeny vo viacer\u00fdch oblastiach, vr\u00e1tane \u00fapravy postavenia a evidencie os\u00f4b v hmotnej n\u00fadzi, podmienok pre zamestn\u00e1vanie \u0161t\u00e1tnych pr\u00edslu\u0161n\u00edkov tret\u00edch kraj\u00edn, spr\u00edsnenia po\u017eiadaviek pre agent\u00fary do\u010dasn\u00e9ho zamestn\u00e1vania, akt\u00edvnych opatren\u00ed na trhu pr\u00e1ce (napr. pr\u00edspevku na aktiva\u010dn\u00fa \u010dinnos\u0165, pr\u00edspevku na doch\u00e1dzku za pr\u00e1cou), sez\u00f3nneho zamestnania a in\u00fdch.<\/p>\n<p>Pre\u010d\u00edtajte si preh\u013ead vybran\u00fdch zmien, ktor\u00e9 Novela priniesla oproti aktu\u00e1lnej pr\u00e1vnej \u00faprave:<\/p>\n<ol>\n<li>\n<h3>Sez\u00f3nne zamestnanie \u0161t\u00e1tnych pr\u00edslu\u0161n\u00edkov tret\u00edch kraj\u00edn<\/h3>\n<\/li>\n<\/ol>\n<p>Maxim\u00e1lne obdobie trvania sez\u00f3nneho zamestnania sa predl\u017euje zo 180 na <u>240 dn\u00ed<\/u> po\u010das 12 po sebe nasleduj\u00facich mesiacov. T\u00fdm sa zos\u00faladila t\u00e1to pr\u00e1vna \u00faprava (pre ob\u010danov z\u00a0kraj\u00edn mimo E\u00da) so v\u0161eobecnou \u00fapravou sez\u00f3nnych pr\u00e1c pod\u013ea Z\u00e1konn\u00edk pr\u00e1ce (ktor\u00fd stanovuje maxim\u00e1lne trvanie 8 mesiacov pre sez\u00f3nne pr\u00e1ce). V nadv\u00e4znosti na t\u00fato zmenu sa upravuje aj obdobie, na ktor\u00e9 sa vyd\u00e1va potvrdenie o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta, ak ide o sez\u00f3nne zamestnanie.<\/p>\n<p>Novela tie\u017e zav\u00e1dza nov\u00fa podmienku pre udelenie povolenia na zamestnanie na \u00fa\u010del sez\u00f3nneho zamestnania t\u00fdkaj\u00facu sa <u>ubytovania<\/u>. Ak ubytovanie zabezpe\u010duje alebo sprostredk\u00fava zamestn\u00e1vate\u013e, m\u00f4\u017ee od \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny vy\u017eadova\u0165 n\u00e1jomn\u00e9, resp. in\u00fa \u00fahradu len v\u00a0takej v\u00fd\u0161ke, \u017ee nebude neprimerane vysok\u00e9\/\u00e1 vzh\u013eadom na mesa\u010dn\u00fa \u010dist\u00fa mzdu tak\u00e9ho zamestnanca alebo zamestnankyne a kvalitu ubytovania. Za \u00fa\u010delom preuk\u00e1zania splnenia tejto podmienky je zamestn\u00e1vate\u013e pri \u017eiadosti o\u00a0udelenia povolenia na zamestnanie povinn\u00fd prilo\u017ei\u0165 aj n\u00e1jomn\u00fa alebo in\u00fa zmluvu (ak zamestn\u00e1vate\u013e zabezpe\u010duje alebo sprostredk\u00fava ubytovanie).<\/p>\n<p>\u010eal\u0161ou zmenou je <u>zavedenie pr\u00e1vneho n\u00e1roku na jedno pred\u013a\u017eenie povolenia na sez\u00f3nne zamestnanie<\/u>, ak si sez\u00f3nni zamestnanci predl\u017euj\u00fa zmluvu s rovnak\u00fdm zamestn\u00e1vate\u013eom, resp. sa zamestnaj\u00fa u in\u00e9ho zamestn\u00e1vate\u013ea. Doteraz bolo rozhodnutie o\u00a0pred\u013a\u017een\u00ed na \u00favahe pr\u00edslu\u0161n\u00e9ho \u00faradu. V\u00a0zmysle Novely z\u00e1kon v\u00fdslovne stanovuje pr\u00e1vny n\u00e1rok na jedno pred\u013a\u017eenie povolenia pri splnen\u00ed ostatn\u00fdch z\u00e1konn\u00fdch podmienok.<\/p>\n<ol start=\"2\">\n<li>\n<h3>In\u00e9 zmeny v oblasti zamestn\u00e1vania ob\u010danov tret\u00edch kraj\u00edn<\/h3>\n<\/li>\n<\/ol>\n<p><strong><u>Pokra\u010dovanie v\u00a0zamestnan\u00ed po\u010das konania o\u00a0obnovenie modrej karty alebo konania o\u00a0obnove prechodn\u00e9ho pobytu na \u00fa\u010dely zamestnania<\/u>:<\/strong> Novela so sebou prin\u00e1\u0161a mo\u017enos\u0165 pre\u202f\u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny, ktor\u00e9mu uplynula platnos\u0165 modrej karty a ktor\u00fd po\u017eiadal o obnovenie modrej karty, pokra\u010dova\u0165 vo v\u00fdkone zamestnania po\u010das konania o obnovenie modrej karty (ak je vydan\u00e9 potvrdenie o\u202fmo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta, ktor\u00e9 zodpoved\u00e1 vysokokvalifikovan\u00e9mu zamestnaniu, ktor\u00e9 obsahuje s\u00fahlas s\u00a0jeho obsaden\u00edm). Podobne to plat\u00ed aj pri obnove prechodn\u00e9ho pobytu na z\u00e1klade potvrdenia o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta, ktor\u00e9 obsahuje s\u00fahlas s jeho obsaden\u00edm \u2013 a\u017e do pr\u00e1voplatn\u00e9ho skon\u010denia konania o obnovenie prechodn\u00e9ho pobytu bude zamestnanec alebo zamestnanky\u0148a z\u00a0kraj\u00edn mimo E\u00da by\u0165 na\u010falej zamestnan\u00fd\/\u00e1.<\/p>\n<p><strong><u>Do\u010dasn\u00e9 pridelenie k\u00a0in\u00e9mu zamestn\u00e1vate\u013eovi:<\/u><\/strong> Doteraz platilo, \u017ee ADZ nesmie v\u00a0r\u00e1mci udelen\u00e9ho prechodn\u00e9ho pobytu pre \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny (mimo E\u00da) tohto do\u010dasne prideli\u0165 k\u00a0in\u00e9mu zamestn\u00e1vate\u013eovi. Teda, v\u00a0r\u00e1mci udelen\u00e9ho prechodn\u00e9ho pobytu bolo mo\u017en\u00e9 (na z\u00e1klade potvrdenia o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta v zamestnan\u00ed s nedostatkom pracovnej sily) iba do\u010dasn\u00e9 pridelenie k\u00a0jedn\u00e9mu konkr\u00e9tnemu u\u017e\u00edvate\u013esk\u00e9mu zamestn\u00e1vate\u013eovi. Novela umo\u017e\u0148uje, \u017ee v pr\u00edpade, ak do\u010dasn\u00e9 pridelenie \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka skon\u010di sk\u00f4r, ako je obdobie, na ktor\u00e9 mu bol udelen\u00fd alebo obnoven\u00fd prechodn\u00fd pobyt na \u00fa\u010del zamestnania, ADZ m\u00f4\u017ee v r\u00e1mci udelen\u00e9ho prechodn\u00e9ho pobytu tohto \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny jedenkr\u00e1t do\u010dasne prideli\u0165 za najmenej rovnako priazniv\u00fdch mzdov\u00fdch podmienok k in\u00e9mu u\u017e\u00edvate\u013esk\u00e9mu zamestn\u00e1vate\u013eovi na z\u00e1klade potvrdenia o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta, ktor\u00e9 obsahuje s\u00fahlas s jeho obsaden\u00edm.<\/p>\n<ol start=\"3\">\n<li>\n<h3>Agent\u00fary do\u010dasn\u00e9ho zamestn\u00e1vania (\u010falej len \u201eADZ\u201c)<\/h3>\n<\/li>\n<\/ol>\n<p>Novela zav\u00e1dza viacer\u00e9 zmeny v pr\u00e1vnej \u00faprave v\u00fdkonu \u010dinnosti ADZ, ktor\u00e9 sa dot\u00fdkaj\u00fa najm\u00e4 nov\u00fdch povinnost\u00ed pre ADZ, novej podmienky d\u00f4veryhodnosti v \u017eiadosti o vydanie povolenia na v\u00fdkon \u010dinnosti ADZ, \u0161pecifik\u00e1cie p\u00f4vodn\u00fdch a pridania nov\u00fdch n\u00e1le\u017eitost\u00ed k \u017eiadosti o vydanie povolenia na vykon\u00e1vanie \u010dinnosti ADZ, stanovenia r\u00e1mca podmienok, ktor\u00e9 mus\u00ed ADZ sp\u013a\u0148a\u0165 po\u010das cel\u00e9ho obdobia platnosti povolenia a vykon\u00e1vania \u010dinnosti a rovnako aj roz\u0161\u00edrenie fakultat\u00edvnych d\u00f4vodov na zru\u0161enie povolenia na v\u00fdkon \u010dinnosti ADZ.<\/p>\n<p>Vo v\u0161eobecnosti sa d\u00e1 poveda\u0165, \u017ee ide o spr\u00edsnenie podmienok v\u00fdkonu \u010dinnosti ADZ v Slovenskej republike.<\/p>\n<p>Ni\u017e\u0161ie vyber\u00e1me niektor\u00e9 zmeny:<\/p>\n<ul>\n<li>Novela <u><strong>zav\u00e1dza d\u00f4veryhodnos\u0165<\/strong> <\/u>ako jednu z podmienok na vydanie povolenia na vykon\u00e1vanie \u010dinnosti ADZ pr\u00e1vnickej osobe alebo fyzickej osobe, pri\u010dom u pr\u00e1vnickej osoby mus\u00ed podmienku d\u00f4veryhodnosti sp\u013a\u0148a\u0165 aj \u0161tatut\u00e1rny organ alebo \u010dlen \u0161tatut\u00e1rneho org\u00e1nu.<\/li>\n<\/ul>\n<p>D\u00f4veryhodn\u00e1 nie je pr\u00e1vnick\u00e1 alebo fyzick\u00e1 osoba,<\/p>\n<ol>\n<li>ktorej bolo zru\u0161en\u00e9 povolenie na vykon\u00e1vanie \u010dinnosti ADZ v obdob\u00ed 3 rokov pred podan\u00edm \u017eiadosti o vydanie povolenia na vykon\u00e1vanie \u010dinnosti ADZ, alebo<\/li>\n<li>ktor\u00e1 v obdob\u00ed 3 rokov pred podan\u00edm \u017eiadosti o vydanie povolenia na vykon\u00e1vanie \u010dinnosti ADZ vykon\u00e1vala funkciu \u0161tatut\u00e1rneho org\u00e1nu alebo \u010dlena \u0161tatut\u00e1rneho org\u00e1nu ADZ v \u010dase, ke\u010f jej bolo zru\u0161en\u00e9 povolenie na vykon\u00e1vanie \u010dinnosti ADZ.<\/li>\n<\/ol>\n<ul>\n<li>Doteraz platilo, \u017ee jednou z\u00a0podmienok na z\u00edskanie povolenia ADZ je <strong><u>vlastn\u00e9 imanie<\/u><\/strong> vo v\u00fd\u0161ke aspo\u0148 30 000 EUR. Novela stanovila, \u017ee z\u00e1kladn\u00e9 imanie sa do tejto \u010diastky nebude zapo\u010d\u00edtava\u0165, teda, ADZ mus\u00ed disponova\u0165 vlastn\u00fdm iman\u00edm vo v\u00fd\u0161ke 30 000 EUR nad r\u00e1mec z\u00e1kladn\u00e9ho imania.<\/li>\n<li>Novela stanovila, \u017ee relevantn\u00e9 podmienky na z\u00edskanie povolenia na \u010dinnos\u0165 ADZ bude ADZ musie\u0165 sp\u013a\u0148a\u0165 aj po\u010das celej doby platnosti povolenia.<\/li>\n<\/ul>\n<p>***<\/p>\n<p>Tento pr\u00e1vny preh\u013ead bol pripraven\u00fd v septembri 2025 v\u00fdlu\u010dne na \u00fa\u010dely poskytnutia v\u0161eobecnej inform\u00e1cie a nem\u00e1 by\u0165 pova\u017eovan\u00fd za pr\u00e1vne poradenstvo. Vy\u0161\u0161ie uveden\u00fd preh\u013ead nie je komplexn\u00fd a iba stru\u010dne sumarizuje niektor\u00e9 zmeny pr\u00e1vnej \u00fapravy.
