Av\u0161ak s\u00fa aj tak\u00ed zamestn\u00e1vatelia, ktor\u00ed pr\u00e1ve\u017ee aktu\u00e1lne nemaj\u00fa dostatok zamestnancov (napr. z d\u00f4vodu uzatvorenia \u0161k\u00f4l, ktor\u00e9 sp\u00f4sobilo, \u017ee mnoh\u00ed zamestnanci museli osta\u0165 doma so svojimi de\u0165mi alebo z d\u00f4vodu karant\u00e9ny zamestnancov, a pod.). Jedn\u00fdm z rie\u0161en\u00ed tohto probl\u00e9mu by tak pre tieto skupiny zamestn\u00e1vate\u013eov mohlo by\u0165 do\u010dasn\u00e9 pridelenie zamestnancov od zamestn\u00e1vate\u013ea, ktor\u00fd m\u00e1 aktu\u00e1lny \u201enadbytok\u201c zamestnancov (pre ktor\u00fdch nem\u00e1 pr\u00e1cu) k zamestn\u00e1vate\u013eovi, ktor\u00fd nem\u00e1 dos\u0165 vlastn\u00fdch zamestnancov. Samozrejme, tento re\u017eim sa ned\u00e1 vyu\u017ei\u0165 pri v\u0161etk\u00fdch typoch podnikania, ale iba v tak\u00fdch oblastiach, kde sa zamestnanci relat\u00edvne r\u00fdchlo vedia zau\u010di\u0165 na pr\u00e1cu, ktor\u00fa by mali vykon\u00e1va\u0165.<\/p>\n<p><span style=\"font-size: 18pt;\">Podmienky do\u010dasn\u00e9ho pridelenia<\/span><\/p>\n<p>Do\u010dasn\u00e9 pridelenie k\u00a0tzv.\u00a0u\u017e\u00edvate\u013esk\u00e9mu zamestn\u00e1vate\u013eovi je mo\u017en\u00e9 dohodn\u00fa\u0165 na z\u00e1klade objekt\u00edvnych prev\u00e1dzkov\u00fdch d\u00f4vodov zamestn\u00e1vate\u013ea. Pod\u013ea n\u00e1\u0161ho n\u00e1zoru v\u00a0s\u00fa\u010dasnej situ\u00e1cii, ke\u010f zamestn\u00e1vate\u013e objekt\u00edvne nem\u00e1 pr\u00e1cu pre svojich zamestnancov kv\u00f4li d\u00f4sledkom pand\u00e9mie COVID-19, tieto objekt\u00edvne prev\u00e1dzkov\u00e9 d\u00f4vody s\u00fa dan\u00e9. K\u00a0u\u017e\u00edvate\u013esk\u00e9mu zamestn\u00e1vate\u013eovi mo\u017eno prideli\u0165 iba zamestnanca v pracovnom pomere, ktor\u00fd u\u00a0zamestn\u00e1vate\u013ea pracuje aspo\u0148 3 mesiace. Nie je teda mo\u017en\u00e9 do\u010dasne prideli\u0165 zamestnancov pracuj\u00facich na z\u00e1klade doh\u00f4d mimo pracovn\u00e9ho pomeru.<\/p>\n<p>Z\u00e1kladom do\u010dasn\u00e9ho pridelenia zamestnanca je:<\/p>\n<ul>\n<li>p\u00edsomn\u00e1 dohoda o do\u010dasnom pridelen\u00ed uzatvoren\u00e1 medzi zamestn\u00e1vate\u013eom (ktor\u00fd zamestnanca pride\u013euje) a\u00a0zamestnancom, a<\/li>\n<li>p\u00edsomn\u00e1 dohoda o do\u010dasnom pridelen\u00ed uzatvoren\u00e1 medzi zamestn\u00e1vate\u013eom (ktor\u00fd zamestnanca pride\u013euje) a u\u017e\u00edvate\u013esk\u00fdm zamestn\u00e1vate\u013eom (ku ktor\u00e9mu bude zamestnanec pridelen\u00fd).<\/li>\n<\/ul>\n<p>Tieto dohody musia obsahova\u0165 z\u00e1konom predp\u00edsan\u00e9 n\u00e1le\u017eitosti podrobnosti.<\/p>\n<p><span style=\"font-size: 18pt;\">V\u00fdkon pr\u00e1ce a\u00a0poskytovanie mzdy po\u010das do\u010dasn\u00e9ho pridelenia<\/span><\/p>\n<p>Po\u010das do\u010dasn\u00e9ho pridelenia uklad\u00e1 zamestnancovi pracovn\u00e9 \u00falohy, organizuje, riadi a kontroluje jeho pr\u00e1cu u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e, ku ktor\u00e9mu je zamestnanec do\u010dasne pridelen\u00fd. U\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e mu takisto na tento \u00fa\u010del d\u00e1va pokyny, utv\u00e1ra priazniv\u00e9 pracovn\u00e9 podmienky a zais\u0165uje bezpe\u010dnos\u0165 a ochranu zdravia pri pr\u00e1ci.<\/p>\n<p>Do\u010dasne pridelen\u00e9mu zamestnancovi v\u0161ak poskytuje mzdu, n\u00e1hradu mzdy a cestovn\u00e9 n\u00e1hrady aj na\u010falej jeho zvy\u010dajn\u00fd zamestn\u00e1vate\u013e, t.j. nie u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e. Ten sa v\u0161ak m\u00f4\u017ee s u\u017e\u00edvate\u013esk\u00fdm zamestn\u00e1vate\u013eom dohodn\u00fa\u0165 na kompenz\u00e1cii t\u00fdchto n\u00e1kladov. Do\u010dasn\u00e9 pridelenie by sa ale nemalo v tomto re\u017eime uskuto\u010d\u0148ova\u0165 za odplatu, nako\u013eko na v\u00fdkon podnikate\u013eskej \u010dinnosti do\u010dasn\u00e9ho pride\u013eovania zamestnancov (teda za \u00fa\u010delom dosiahnutia zisku z tejto \u010dinnosti) s\u00fa opr\u00e1vnen\u00e9 iba agent\u00fary do\u010dasn\u00e9ho zamestn\u00e1vania s pr\u00edslu\u0161n\u00fdm povolen\u00edm.<\/p>\n<p>Pri do\u010dasnom pridelen\u00ed pracovn\u00e9 podmienky (vr\u00e1tane mzdov\u00fdch podmienok) a podmienky zamestn\u00e1vania pridelen\u00e9ho zamestnanca musia by\u0165 najmenej rovnako priazniv\u00e9 ako u porovnate\u013en\u00e9ho zamestnanca u\u017e\u00edvate\u013esk\u00e9ho zamestn\u00e1vate\u013ea. Ak teda zamestn\u00e1vate\u013e z\u00a0d\u00f4vodu nedostatku pr\u00e1ce pridel\u00ed svojho zamestnanca k\u00a0in\u00e9mu zamestn\u00e1vate\u013eovi, mus\u00ed mu poskytn\u00fa\u0165 aspo\u0148 tak\u00e9 pracovn\u00e9 podmienky (vr\u00e1tane mzdy a\u00a0in\u00fdch v\u00fdhod), ako poskytuje u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e svojim zamestnancom na rovnakej, resp. porovnate\u013enej pracovnej poz\u00edcii. To m\u00f4\u017ee znamena\u0165, \u017ee pr\u00edpadne po\u010das do\u010dasn\u00e9ho pridelenia bude hradi\u0165 zamestnancovi vy\u0161\u0161iu mzdu (t\u00fato mu ale u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e m\u00f4\u017ee kompenzova\u0165).<\/p>\n<p>\u010ci\u017ee mzdu m\u00e1 hradi\u0165 zamestnancovi na\u010falej jeho zvy\u010dajn\u00fd zamestn\u00e1vate\u013e. Av\u0161ak ak tento zamestn\u00e1vate\u013e neposkytne do\u010dasne pridelen\u00e9mu zamestnancovi mzdu najmenej rovnako priazniv\u00fa ako patr\u00ed porovnate\u013en\u00e9mu zamestnancovi u\u017e\u00edvate\u013esk\u00e9ho zamestn\u00e1vate\u013ea, u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e akoby ru\u010d\u00ed za t\u00fato povinnos\u0165, preto\u017ee v\u00a0takom pr\u00edpade on je povinn\u00fd poskytn\u00fa\u0165 zamestnancovi t\u00fato mzdu, resp. rozdiel medzi mzdou porovnate\u013en\u00e9ho zamestnanca u\u017e\u00edvate\u013esk\u00e9ho zamestn\u00e1vate\u013ea a mzdou, ktor\u00fa mu poskytol zvy\u010dajn\u00fd zamestn\u00e1vate\u013e.<\/p>\n<p>Oh\u013eadom do\u010dasn\u00e9ho pridelenia platia \u010fal\u0161ie obmedzenia a\u00a0podmienky, ktor\u00e9 v\u00a0z\u00e1ujme zachovania stru\u010dnosti a\u00a0jednoduchosti tejto inform\u00e1cie nepopisujeme.
