Pre\u010d\u00edtajte si n\u00e1\u0161 stru\u010dn\u00fd preh\u013ead.<\/p>\n<p><strong>Ml\u010danlivos\u0165 zamestnanca o\u00a0v\u00fd\u0161ke mzdy<\/strong><\/p>\n<p>Na z\u00e1klade zmeny Z\u00e1konn\u00edka pr\u00e1ce zamestn\u00e1vate\u013e od 1.1.2019 nebude opr\u00e1vnen\u00fd ak\u00fdmko\u013evek sp\u00f4sobom po\u017eadova\u0165 od zamestnanca, aby zachov\u00e1val ml\u010danlivos\u0165 o svojej mzde, ale aj pracovn\u00fdch podmienkach u\u00a0zamestn\u00e1vate\u013ea ako tak\u00fdch. T\u00e1to nov\u00e1 \u00faprava sa bude vz\u0165ahova\u0165 aj na dohody o pr\u00e1cach vykon\u00e1van\u00fdch mimo pracovn\u00e9ho pomeru alebo in\u00e9 dohody medzi zamestn\u00e1vate\u013eom a\u00a0zamestnancom, ktor\u00e9 by zamestnanca zav\u00e4zovali zachov\u00e1va\u0165 ml\u010danlivos\u0165.<\/p>\n<p>Ustanovenia, ktor\u00e9 upravuj\u00fa povinnos\u0165 ml\u010danlivosti zamestnanca o\u00a0v\u00fd\u0161ke mzdy alebo in\u00fdch pracovn\u00fdch podmienkach, ktor\u00e9 s\u00fa pravidelne s\u00fa\u010das\u0165ou pracovn\u00fdch zml\u00fav, bud\u00fa v\u00a0zmysle novelizovan\u00e9ho Z\u00e1konn\u00edka pr\u00e1ce pova\u017eovan\u00e9 za neplatn\u00e9 a\u00a0nebude ich tak mo\u017en\u00e9 v\u00a0bud\u00facnosti v zmluv\u00e1ch uv\u00e1dza\u0165. Za neplatn\u00e9 sa bud\u00fa rovnako pova\u017eova\u0165 ak\u00e9ko\u013evek ustanovenia \u010di intern\u00e9 predpisy, ktor\u00e9 by ukladali ak\u00e9ko\u013evek sankcie zamestnancovi v\u00a0tejto s\u00favislosti.<\/p>\n<p>Pri existuj\u00facich vzoroch pracovn\u00fdch zml\u00fav, ktor\u00e9 obsahuj\u00fa povinnos\u0165 ml\u010danlivosti, bude potrebn\u00e9 prist\u00fapi\u0165 k\u00a0ich zmene, nako\u013eko v opa\u010dnom pr\u00edpade sa zamestn\u00e1vate\u013e vystav\u00ed riziku poru\u0161enia z\u00e1kona a\u00a0sankcie od in\u0161pektor\u00e1tu pr\u00e1ce. Bude taktie\u017e vhodn\u00e9 aktualizova\u0165 aj sk\u00f4r uzavret\u00e9 pracovn\u00e9 zmluvy, aby zodpovedali platn\u00e9mu pr\u00e1vnemu stavu.<\/p>\n<p><strong>Povinn\u00e9 nahlasovanie vo\u013en\u00fdch pracovn\u00fdch miest \u00faradom pr\u00e1ce<\/strong><\/p>\n<p>Od 1.1.2019 zav\u00e1dza Z\u00e1kon o\u00a0slu\u017eb\u00e1ch zamestnanosti povinnos\u0165 zamestn\u00e1vate\u013ea ozn\u00e1mi\u0165 ka\u017ed\u00e9 vo\u013en\u00e9 pracovn\u00e9 miesto a jeho charakteristiku \u00faradu pr\u00e1ce, v ktor\u00e9ho \u00fazemnom obvode sa pracovn\u00e9 miesto nach\u00e1dza, pri\u010dom poru\u0161enie tejto povinnosti bude sankcionovate\u013en\u00e9 a\u017e do v\u00fd\u0161ky 300 eur, potenci\u00e1lne za ka\u017ed\u00e9 neohl\u00e1sen\u00e9 pracovn\u00e9 miesto.<\/p>\n<p>Pod\u013ea vyjadren\u00ed z\u00e1stupcov \u00dastredia pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny (\u00daPSVR) bude t\u00e1to podmienka splnen\u00e1, ak bude zamestn\u00e1vate\u013e inzerova\u0165 vo\u013en\u00e9 pracovn\u00e9 miesto na port\u00e1loch <a href=\"http:\/\/www.profesia.sk\">www.profesia.sk<\/a> a www.kariera.zoznam.sk, a to na z\u00e1klade dohody medzi uveden\u00fdmi port\u00e1lmi a \u00daPSVR o v\u00fdmene inform\u00e1ci\u00ed. Tak\u00fdto postup nem\u00e1 jednozna\u010dn\u00fa oporu v\u00a0z\u00e1kone, av\u0161ak vzh\u013eadom na to, \u017ee sa jedn\u00e1 o\u00a0vyjadrenia samotn\u00e9ho \u00daPSVR, je mo\u017en\u00e9 o\u010dak\u00e1va\u0165, \u017ee v\u00a0praktickej rovine bude tento akceptovan\u00fd.<\/p>\n<p><strong>Zamestn\u00e1vanie pracovn\u00edkov z tret\u00edch kraj\u00edn mimo E\u00da<\/strong><\/p>\n<p>S\u00a0\u00fa\u010dinnos\u0165ou od 1.1.2019 sa men\u00ed Z\u00e1kon o\u00a0slu\u017eb\u00e1ch zamestnanosti v oblasti flexibility zamestn\u00e1vania pracovn\u00edkov z kraj\u00edn mimo E\u00da. Prijat\u00e9 opatrenia maj\u00fa za cie\u013e otvori\u0165 pracovn\u00fd trh a\u00a0u\u013eah\u010di\u0165 slovensk\u00fdm zamestn\u00e1vate\u013eom obsadenie pracovn\u00fdch poz\u00edci\u00ed najm\u00e4 zjednodu\u0161en\u00edm a\u00a0skr\u00e1ten\u00edm procesu prij\u00edmania t\u00fdchto os\u00f4b.<\/p>\n<p>Medzi najd\u00f4le\u017eitej\u0161ie zmeny patria predov\u0161etk\u00fdm:<\/p>\n<ul>\n<li>Nahradenie ro\u010dn\u00e9ho zverej\u0148ovania zoznamu zamestnan\u00ed s nedostatkom pracovnej sily flexibilnej\u0161\u00edm zverej\u0148ovan\u00edm zoznamu \u0161tvr\u0165ro\u010dne, ktor\u00e9 bude lep\u0161ie odr\u00e1\u017ea\u0165 aktu\u00e1lnu situ\u00e1ciu na trhu pr\u00e1ce. Z\u00e1rove\u0148 sa ru\u0161ia niektor\u00e9 duplicitn\u00e9 povinnosti zamestn\u00e1vate\u013eov vo vz\u0165ahu k\u00a0zverej\u0148ovaniu vo\u013en\u00fdch pracovn\u00fdch miest.<\/li>\n<li>Zjednodu\u0161enie prij\u00edmania cudzincov z tret\u00edch kraj\u00edn najm\u00e4 pri zamestnaniach s nedostatkom pracovnej sily v okresoch s\u00a0n\u00edzkou nezamestnanos\u0165ou, t.j. pod 5 %.<\/li>\n<li>Umo\u017enenie do\u010dasn\u00e9ho pride\u013eovania cudzincov z\u00a0tret\u00edch kraj\u00edn zamestn\u00e1vate\u013emi a agent\u00farami do\u010dasn\u00e9ho zamestn\u00e1vania na v\u00fdkon pr\u00e1ce, ak ide o v\u00fdkon zamestnania s nedostatkom pracovnej sily v okresoch s\u00a0priemernou mierou evidovanej nezamestnanosti ni\u017e\u0161ou ako 5 %.<\/li>\n<li>Zamestn\u00e1vate\u013e alebo u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e v\u00a0pr\u00edpade do\u010dasn\u00e9ho pridelenia bude opr\u00e1vnen\u00fd obsadi\u0165 svoje vo\u013en\u00e9 kapacity cudzincami z tret\u00edch kraj\u00edn len za podmienky neporu\u0161enia z\u00e1kazu neleg\u00e1lneho zamestn\u00e1vania po\u010das posledn\u00fdch piatich rokov.<\/li>\n<li>Skr\u00e1tenie leh\u00f4t na posudzovanie \u017eiadost\u00ed o udelenie prechodn\u00e9ho pobytu z 90 na 30 dn\u00ed pri splnen\u00ed z\u00e1konn\u00fdch podmienok (napr. ak sa jedn\u00e1 o\u00a0zamestnanie s nedostatkom pracovnej sily v okresoch s\u00a0n\u00edzkou nezamestnanos\u0165ou alebo zamestnancov centier podnikov\u00fdch slu\u017eieb a technologick\u00fdch centier).<\/li>\n<li>Zjednodu\u0161enie podmienok predkladania dokladov o dosiahnutom vzdelan\u00ed. Povinnos\u0165 preuk\u00e1zania dosiahnut\u00e9ho vzdelania <u>pred<\/u> povolen\u00edm zamestnania bude ponechan\u00e1 len pre regulovan\u00e9 povolania.<\/li>\n<li>Zmeny sa okrem in\u00e9ho maj\u00fa dotkn\u00fa\u0165 aj sez\u00f3nneho zamestn\u00e1vania u\u00a0slovensk\u00fdch zamestn\u00e1vate\u013eov (napr. zmeny pri lehot\u00e1ch na nahl\u00e1senia vo\u013en\u00e9ho pracovn\u00e9ho miesta na \u00fa\u010del sez\u00f3nneho zamestnania).<\/li>\n<\/ul>\n<p>\u010eal\u0161ie pr\u00e1vne novinky n\u00e1jdete taktie\u017e na na\u0161ich firemn\u00fdch profiloch na soci\u00e1lnych sie\u0165ach LinkedIn a Facebook, pre ich pravideln\u00fd odber n\u00e1s sledujte na t\u00fdchto sie\u0165ach.<\/p>\n<p style=\"text-align: left;\">***<\/p>\n<p>9.1.2019.
