Z\u00e1kon o\u00a0whistlebloweroch reaguje na rozli\u010dn\u00e9 pr\u00e1vne nedostatky predch\u00e1dzaj\u00facej \u00fapravy (absencia zodpovednosti konkr\u00e9tnej osoby za sankcionovanie oznamovate\u013ea, pr\u00edp. vyzradenie jeho toto\u017enosti) a\u00a0z\u00e1rove\u0148 implementuje poznatky z\u00edskan\u00e9 z aplika\u010dnej praxe (napr. n\u00edzka propag\u00e1cia a diskusia vo vz\u0165ahu k\u00a0\u0161ir\u0161ej verejnosti).<\/p>\n<p>Z\u00e1kon prin\u00e1\u0161a viacer\u00e9 novinky v \u00faprave ochrany oznamovate\u013eov protispolo\u010denskej \u010dinnosti na Slovensku, ak\u00fdmi s\u00fa napr\u00edklad zriadenie osobitn\u00e9ho (nov\u00e9ho) \u00daradu na ochranu oznamovate\u013eov protispolo\u010denskej \u010dinnosti (niektor\u00e9 jeho kompetencie bude e\u0161te ur\u010dit\u00e9 obdobie do\u010dasne vykon\u00e1va\u0165 pr\u00edslu\u0161n\u00fd in\u0161pektor\u00e1t pr\u00e1ce), roz\u0161\u00edrenie ochrany a\u00a0opr\u00e1vnen\u00ed oznamovate\u013ea v\u00a0trestnom \u010di spr\u00e1vnom konan\u00ed, terminologick\u00e9 zmeny, a\u00a0pod. Ni\u017e\u0161ie v\u00a0texte prin\u00e1\u0161ame <u>sum\u00e1r najpodstatnej\u0161\u00edch zmien<\/u> oproti predch\u00e1dzaj\u00facej pr\u00e1vnej \u00faprave, na ktor\u00e9 by (nielen) zamestn\u00e1vatelia na Slovensku mali by\u0165 pripraven\u00ed v\u00a0bud\u00facnosti kvalifikovane reagova\u0165:<\/p>\n<ul>\n<li><strong>Vn\u00fatorn\u00fd syst\u00e9m preverovania ozn\u00e1men\u00ed<\/strong> \u2013 zav\u00e1dzaj\u00fa sa nov\u00e9 <u>materi\u00e1lne i\u00a0form\u00e1lne po\u017eiadavky<\/u> na intern\u00e9 vybavovanie ozn\u00e1men\u00ed (i na\u010falej povinn\u00e9 len pre s\u00fakromnopr\u00e1vnych zamestn\u00e1vate\u013eov s\u00a0po\u010dtom zamestnancov nad 50). Z\u00e1kon o\u00a0whistlebloweroch explicitne zakotvuje nov\u00fa po\u017eiadavku, aby zamestn\u00e1vate\u013e (v z\u00e1vislosti od jeho ve\u013ekosti a\u00a0organiza\u010dnej \u0161trukt\u00fary, nastaven\u00fdch intern\u00fdch pravidiel a\u00a0pod.) prijal tak\u00e9 technick\u00e9 a organiza\u010dn\u00e9 opatrenia, ktor\u00e9 zodpovedaj\u00fa najnov\u0161\u00edm poznatkom (pri zoh\u013eadnen\u00ed v\u00fd\u0161ky n\u00e1kladov na ich vykonanie a mo\u017enostiam zamestn\u00e1vate\u013ea na zabezpe\u010denie preverovania ozn\u00e1men\u00ed v s\u00falade so z\u00e1konom). Takisto ozna\u010denie zodpovednej osoby a sp\u00f4soby pod\u00e1vania ozn\u00e1men\u00ed musia by\u0165 <u>zverejnen\u00e9<\/u> a pre v\u0161etk\u00fdch zamestnancov <u>pr\u00edstupn\u00e9 obvykl\u00fdm a be\u017ene dostupn\u00fdm sp\u00f4sobom<\/u> tak, \u017ee najmenej jeden sp\u00f4sob pod\u00e1vania ozn\u00e1men\u00ed mus\u00ed by\u0165 pr\u00edstupn\u00fd <u>nepretr\u017eite<\/u> (napr. online). Zamestn\u00e1vate\u013e je povinn\u00fd spr\u00edstupni\u0165 inform\u00e1cie o vn\u00fatornom syst\u00e9me preverovania ozn\u00e1men\u00ed v <u>stru\u010dnej<\/u>, <u>zrozumite\u013enej<\/u>, <u>jasne formulovanej<\/u> a <u>\u013eahko dostupnej forme.<\/u> <u>Zamestn\u00e1vate\u013e je povinn\u00fd zos\u00faladi\u0165 vn\u00fatorn\u00fd syst\u00e9m vybavovania podnetov pod\u013ea doteraj\u0161ieho z\u00e1kona pod\u013ea po\u017eiadaviek nov\u00e9ho Z\u00e1kona o whistlebloweroch do 30. septembra 2019<\/u>;<\/li>\n<li><strong>Ochrana oznamovate\u013eov, ktor\u00ed vyst\u00fapia verejne \u2013 <\/strong>po novom sa roz\u0161iruje mo\u017enos\u0165 vyu\u017ei\u0165 in\u0161tit\u00fat pozastavenia \u00fa\u010dinnosti pracovnopr\u00e1vneho \u00fakonu aj na \u010fal\u0161ie osoby. Ide o pr\u00edpad, ke\u010f fyzick\u00e1 osoba nepod\u00e1 ozn\u00e1menie pr\u00edslu\u0161n\u00e9mu org\u00e1nu alebo zamestn\u00e1vate\u013eovi, ale <u>skuto\u010dnosti o protispolo\u010denskej \u010dinnosti zverejn\u00ed<\/u>. Podmienkou v\u0161ak je, \u017ee t\u00e1to osoba sa mus\u00ed opr\u00e1vnene domnieva\u0165, \u017ee podanie ozn\u00e1menia by neviedlo k jeho riadnemu pre\u0161etreniu, resp. by mohlo vies\u0165 k jej postihu. Povinnos\u0165 ml\u010danlivosti zverej\u0148uj\u00facej osoby t\u00fdm nie je dotknut\u00e1;<\/li>\n<li><strong>Mo\u017enos\u0165 pozastavenia \u00fa\u010dinnosti pracovnopr\u00e1vneho \u00fakonu aj vo vz\u0165ahu k\u00a0in\u00fdm osob\u00e1m<\/strong> \u2013 pr\u00edslu\u0161n\u00e9 ustanovenia o\u00a0pozastaven\u00ed \u00fa\u010dinnosti pracovnopr\u00e1vneho \u00fakonu (\u00a712 Z\u00e1kona o\u00a0whistlebloweroch) sa okrem samotn\u00e9ho oznamovate\u013ea a\u00a0jeho bl\u00edzku osobu primerane vz\u0165ahuj\u00fa aj na zodpovedn\u00fa osobu a na zamestnancov, ktor\u00ed sa podie\u013eaj\u00fa na plnen\u00ed \u00faloh zodpovednej osoby (\u00fa\u010delom novej \u00fapravy je zamedzi\u0165 ne\u017eelan\u00fdm z\u00e1sahom do \u010dinnosti zodpovednej osoby a posilni\u0165 jej nez\u00e1vislos\u0165 a t\u00fdm aj akcieschopnos\u0165);<\/li>\n<li><strong>Podmienky fungovania zodpovednej osoby<\/strong> \u2013 Z\u00e1kon o\u00a0whistlebloweroch spres\u0148uje \u00fapravu postavenia zodpovednej osoby v r\u00e1mci pr\u00e1vnickej osoby za \u00fa\u010delom zabezpe\u010denia jej nez\u00e1vislosti (zodpovedn\u00e1 osoba m\u00f4\u017ee plni\u0165 aj in\u00e9 \u00falohy, tie v\u0161ak nesm\u00fa vies\u0165 ku <u>konfliktu z\u00e1ujmu<\/u>). Zamestn\u00e1vate\u013e ju <u>nesmie za v\u00fdkon jej \u00faloh postihova\u0165<\/u> a mus\u00ed jej umo\u017eni\u0165 nez\u00e1visl\u00e9 plnenie \u00faloh vr\u00e1tane <u>poskytnutia dostato\u010dn\u00fdch prostriedkov a\u00a0s\u00fa\u010dinnosti<\/u>). Zodpovedn\u00e1 osoba mus\u00ed ma\u0165 <u>odborn\u00e9 predpoklady<\/u> na plnenie \u00faloh a zamestn\u00e1vate\u013e mus\u00ed priebe\u017ene <u>zabezpe\u010dova\u0165 ich udr\u017eiavanie<\/u> (nezav\u00e1dzaj\u00fa sa v\u0161ak r\u00f4zne form\u00e1lne \u0161kolenia, kurzy, osved\u010denia a\u00a0podobne \u2013 naplnenie t\u00fdchto v\u0161eobecn\u00fdch krit\u00e9ri\u00ed na kvalifik\u00e1ciu zodpovednej osoby si mus\u00ed zhodnoti\u0165 ka\u017ed\u00fd zamestn\u00e1vate\u013e samostatne);<\/li>\n<li><strong>Administrat\u00edvna zodpovednos\u0165 za poru\u0161enie <\/strong>\u2013 fyzickej osobe (napr. konate\u013e, ved\u00faci HR, a\u00a0pod.), ktor\u00e1 urob\u00ed vo\u010di whistleblowerovi pracovnopr\u00e1vny \u00fakon bez s\u00fahlasu \u00daradu na ochranu oznamovate\u013ea alebo, ktor\u00e1 vyzrad\u00ed toto\u017enos\u0165 whistleblowera, m\u00f4\u017ee by\u0165 udelen\u00e1 <u>pokuta do v\u00fd\u0161ky 2.000 eur<\/u>;<\/li>\n<li><strong>Prenos d\u00f4kazn\u00e9ho bremena na zamestn\u00e1vate\u013ea <\/strong>\u2013 \u00a0zamestn\u00e1vate\u013e je opakovane povinn\u00fd <u>zn\u00e1\u0161a\u0165 obr\u00e1ten\u00e9 d\u00f4kazn\u00e9 bremeno<\/u> pri preukazovan\u00ed legitimity negat\u00edvnych pracovnopr\u00e1vnych \u00fakonov vo\u010di chr\u00e1nen\u00e9mu oznamovate\u013eovi (napr. v\u00a0s\u00favislosti s\u00a0pozastaven\u00edm \u00fa\u010dinnosti pracovnopr\u00e1vneho \u00fakonu, kde v\u00a0doteraj\u0161ej pr\u00e1vnej \u00faprave musel ma\u0165 pr\u00edslu\u0161n\u00fd org\u00e1n \u201ed\u00f4vodn\u00e9 podozrenie\u201c o\u00a0pr\u00ed\u010dinnej s\u00favislosti tohto \u00fakonu s\u00a0ozn\u00e1men\u00edm, aby jeho \u00fa\u010dinnos\u0165 pozastavil; po novom plat\u00ed, \u017ee ak zamestn\u00e1vate\u013e nepreuk\u00e1\u017ee, \u017ee pracovnopr\u00e1vny \u00fakon nem\u00e1 pr\u00ed\u010dinn\u00fa s\u00favislos\u0165 s ozn\u00e1men\u00edm, tak sa \u00fa\u010dinnos\u0165 pracovnopr\u00e1vneho \u00fakonu pozastav\u00ed);<\/li>\n<li><strong>Roz\u0161\u00edrenie defin\u00edcie oznamovate\u013ea<\/strong> \u2013 po novom bude chr\u00e1nen\u00e1 aj bl\u00edzka osoba oznamovate\u013ea, ktor\u00e1 je v pracovnopr\u00e1vnom vz\u0165ahu nielen k\u00a0tomu ist\u00e9mu zamestn\u00e1vate\u013eovi ako oznamovate\u013e, ale aj k zamestn\u00e1vate\u013eovi, ktor\u00fd je <u>z\u00e1vislou osobou<\/u> vo vz\u0165ahu k zamestn\u00e1vate\u013eovi oznamovate\u013ea (napr. rodinn\u00ed pr\u00edslu\u0161n\u00edci) alebo k zamestn\u00e1vate\u013eovi, ktor\u00fd je <u>zalo\u017een\u00fd alebo zriaden\u00fd zamestn\u00e1vate\u013eom<\/u> oznamovate\u013ea (napr. dc\u00e9rska spolo\u010dnos\u0165 \/ organiza\u010dn\u00e1 zlo\u017eka);<\/li>\n<li><strong>Zmeny v\u00a0d\u013a\u017ekach leh\u00f4t <\/strong>\u2013 v\u00a0s\u00favislosti s\u00a0pozastaven\u00edm \u00fa\u010dinnosti pracovnopr\u00e1vneho \u00fakonu sa oproti doteraj\u0161iemu pr\u00e1vnemu stavu predl\u017euj\u00fa lehoty, ktor\u00e9 tento pr\u00e1vny in\u0161tit\u00fat zah\u0155\u0148a \u2013 oznamovate\u013e nebude ma\u0165 len p\u00f4vodn\u00fdch 7 dn\u00ed na po\u017eiadanie o pozastavenie \u00fa\u010dinnosti, ale <u>15 dn\u00ed<\/u>, a platnos\u0165 pozastavenia \u00fa\u010dinnosti nebude 14 dn\u00ed, ale celkovo <u>30 dn\u00ed<\/u>.<\/li>\n<li><strong>Kvalifikovan\u00e9 ozn\u00e1menie<\/strong> \u2013 Z\u00e1kon o\u00a0whistlebloweroch rozli\u0161uje po novom medzi ozn\u00e1men\u00edm (obdoba doteraj\u0161ieho \u201epodnetu\u201c) a\u00a0kvalifikovan\u00fdm ozn\u00e1men\u00edm (obdoba doteraj\u0161ieho \u201eozn\u00e1menia\u201c). S\u00a0kvalifikovan\u00fdm ozn\u00e1men\u00edm je na\u010falej spojen\u00e1 zv\u00fd\u0161en\u00e1 ochrana. Kvalifikovan\u00e9 ozn\u00e1menie u\u017e nemus\u00ed takisto obsahova\u0165 inform\u00e1cie, ktor\u00e9 m\u00f4\u017eu \u201e<u>v\u00fdznamnou mierou<\/u>\u201c nasved\u010dova\u0165 sp\u00e1chaniu, resp. p\u00e1chaniu protispolo\u010denskej \u010dinnosti, sta\u010d\u00ed \u017ee m\u00f4\u017ee prispie\u0165 k objasneniu z\u00e1va\u017enej protispolo\u010denskej \u010dinnosti alebo k zisteniu alebo k usved\u010deniu jej p\u00e1chate\u013ea;<\/li>\n<li><strong>Z\u00e1va\u017en\u00e1 protispolo\u010densk\u00e1 \u010dinnos\u0165<\/strong> \u2013 \u00a0rozsah defin\u00edcie sa dop\u013a\u0148a o\u00a0spr\u00e1vne delikty \u201e<em>za ktor\u00e9 mo\u017eno ulo\u017ei\u0165 pokutu s hornou hranicou ur\u010denou v\u00fdpo\u010dtom<\/em>\u201c (napr. v\u00a0sankcie v\u00a0zmysle GDPR vo v\u00fd\u0161ke do 4% celoro\u010dn\u00e9ho obratu prev\u00e1dzkovate\u013ea). Takisto sa po novom <u>zni\u017euje horn\u00e1 hranica sadzby<\/u> za spr\u00e1vny delikt (z p\u00f4vodn\u00fdch 50.000 eur na 30.000 eur), ktor\u00fd bude pova\u017eovan\u00fd za konanie z\u00e1va\u017enej protispolo\u010denskej \u010dinnosti;<\/li>\n<li><strong>Leg\u00e1lna defin\u00edcia dobrej viery oznamovate\u013ea <\/strong>\u2013 \u00a0ktor\u00e1 sa u\u017e nevia\u017ee na objekt\u00edvnu vedomos\u0165 oznamovate\u013ea, ale na jeho opodstatnenej domnienke o pravdivosti svojich tvrden\u00ed. In\u00fdmi slovami, po novom sta\u010d\u00ed, ak je oznamovate\u013e \u00faprimne presved\u010den\u00fd o\u00a0pravdivosti obsahu svojho ozn\u00e1menia. \u00damyseln\u00e9 (\u0161ikan\u00f3zne) chovanie oznamovate\u013ea nie je samozrejme i\u00a0na\u010falej chr\u00e1nen\u00e9.<\/li>\n<\/ul>\n<p style=\"text-align: left;\">***<\/p>\n<p>Tento pr\u00e1vny preh\u013ead bol pripraven\u00fd v\u00fdlu\u010dne pre \u00fa\u010dely poskytnutia v\u0161eobecnej inform\u00e1cie a\u00a0nem\u00e1 by\u0165 pova\u017eovan\u00fd za pr\u00e1vne poradenstvo.
